Based on the City's policy regarding garage conversions in the Del Monte Park Neighborhood
(see attached memo from the Community Development Director dated December 11, 1986) the
second dwelling unit at 1309 Miles Avenue is presumed to be legal for the following reasons:
0 The garage has been fh existenceinc1957, Building Permit No.9965, issued in 1957 per
Monterey County Tax Assessor Records.
0 Estimated date of construction for the subject unit is in the 1950's. This is based on a review
of the materials and construction techniques found in the unit by the Pacific Grove Building
Inspector.
* There is at least one accessible parking space which is at least 8' x 20' in size and at least
20' beyond the front property line.
As requested by the property owner, a permit for a utility meter split may be issued because it is
not an expansion of the existing uses. Issuance of this permit is conditional upon the subject unit
meeting City Housing Code Requirements.
The dwelling units at 1309 Miles Avenue are a nonconforming use and, therefore, subject to the
zoning regulations pertaining to nonconforming uses, Municipal Code Section 23.68.
